Right to repair

Tenants are entitled to compensation if there is sufficient evidence to establish that the Association has twice failed within the set timescale to undertake a certain urgent qualifying repair or maintenance problem which is likely to jeopardise health, safety or security

The right does not apply in cases where access has been withheld.

In the event the emergency or urgent qualifying repair is not done by the due date, the tenant may inform the Association that the repair has not been done. The Association should then give a further deadline for completing the work, and where reasonably practical, issue a further repair notice and issue a copy to the tenant. If the repair fails to be completed within the second time period, the tenant will be entitled to compensation.
